Where does our experience come from?

Initially, we had branched out to start our own e-Commerce business in the USA and we were hit with the same hurdles as everyone else: The USA tax code and all its complexities. We had multiple calls with lawyers, accountants, state department of revenues and face to face bank meetings, who, on many occasions, provided contradictory advice and clearly lacked the knowledge of international individuals selling online in the USA through marketplaces.

After a significant amount of time and research, we had individuals who were lost on how to remain tax compliant while selling in the USA, reach out to us in search of advice.

  

RJM Tax Exemption began from here. Initially, we were working with around 10 clients a month and 3 staff members - today we work with over 3,000 different businesses all over the world and a team of 20 staff members.

Frequently Asked Questions

How much would it benefit my company to start selling on Amazon in the USA?

In 2021 the total revenue for Amazon sales in Europe was $50.5 Billion; on the same year, the total revenue for Amazon sales in the USA was $302 Billion - We are talking about a 6x increase in sales and volume than the whole of Europe.

I already sell on Amazon in Europe - Can I transfer my listings over if I open a US seller account?

If you already have an Amazon account set up in Europe, you will need to open a new Marketplace for the USA, but you can still use the same name to do this and transfer listings over.

I want to start selling in the USA, but I don’t want to use Amazon, I want to use my own website – Can you help me?

Yes, we can still help but it becomes a lot more complicated from a sales tax perspective. You will need to make sure your website software can charge different sales tax rates depending on the ‘ship to’ address the customer has. A great place to start this would be a Shopify website. Shopify can charge sales tax if you cross a nexus threshold in a state, and we can manage that for you.

Why can’t I open a USA bank account with my European company?

It is possible to open a bank account without a USA company, however, it is significantly more difficult than if you have a US company. Many banks require a face-to-face meeting or extensive checks which we cannot assist with.

Where will you form my LLC?

We would recommend forming it in Wyoming as WY is one of the best states for internationals to open a business in. This is because they have NO state income tax or corporation tax which will save massively in the long run. We use Wyoming for many of our clients.

Are there any other states you would recommend opening my LLC in?

Delaware and Nevada also have the same benefits as Wyoming but are slightly more expensive to set up. 

What are the consequences if I get this business and don’t submit my sales tax filing or IRS tax filing?

Failure to file will result in late filing estimates and penalties from the states for sales tax filing, which can lead to liens being placed on your business in the USA. If you make sales in the US and don’t file an annual return with the IRS, even if you owe no tax due to a tax treaty, you can be fined $25,000.
